The agreement
These terms are an agreement between you, the merchant who installs PopSpin ‑ Spin Wheel Popup (the "App"), and Concat Apps ("we"). By installing or using the App you accept them. If you use the App for a business, you confirm you may accept them for it. Our privacy policy explains how we handle data.
The App
The App adds popups to your Shopify store where visitors play for a prize, usually after signing up. It creates discount codes and Shopify customers, can email rewards, and can send signups to services you connect. The features on each plan are described on our pricing page and in the App.
Plans and billing
- The Free plan costs nothing and collects up to 30 contacts a month.
- Paid plans are charged through Shopify, on your Shopify invoice, every 30 days in US dollars. Shopify's terms apply to those charges, and taxes may be added.
- Paid plans start with a 3-day free trial. If you cancel during the trial, you are not charged.
- You can change or cancel your plan at any time in the App. Uninstalling the App also cancels it. Shopify credits the unused part of a billing period when you downgrade or cancel; we do not otherwise give refunds.
- We may change prices. We will tell you at least 30 days before a change affects you, and a new price applies only once you approve it in Shopify.
Monthly limits
Each plan collects a number of contacts per calendar month (UTC). A signup counts as one contact; on campaigns without a form, each play counts. When you reach your limit, the App allows 10 more plays, then stops showing your popups until the next month or until you upgrade. What you have already collected stays available.
Your responsibilities
You are responsible for how you use the App with your customers, including:
- Collecting consent where the law requires it before sending marketing emails or texts, and honouring unsubscribes. The App records the consent a visitor gives, but you decide what to ask for.
- Telling visitors how you use their information, in your store's own privacy policy.
- Making sure your campaigns follow the laws on promotions, prize draws and games of chance where you sell. Every play in the App is free and every prize is a discount you choose, but the rules differ by country.
- Honouring the discounts and gifts your campaigns offer.
- The content you add, including texts, images and custom code, and the services you connect.
- Keeping your Shopify account, API keys and mail server credentials secure.
Acceptable use
You must not use the App to:
- break the law, or Shopify's terms or Acceptable Use Policy;
- send spam, or collect information from people without telling them;
- mislead visitors about prizes or their chances of winning;
- spread malware, or add custom code that harms visitors;
- overload, probe or interfere with the App, or get around its limits or billing;
- copy, resell or reverse engineer the App.
We may suspend campaigns or accounts that do, and will tell you why when we can.
Shopify and other services
The App runs on Shopify and depends on it. Services you connect, such as Klaviyo, Zapier or your mail server, are provided by others under their own terms. We are not responsible for them, for what they do with data you send them, or for changes they make that stop an integration working, though we will try to keep integrations working.
Your content and ours
You keep everything you add to the App and the subscribers you collect. You let us use it only to provide the App to you. We keep all rights in the App, its templates, code and design. If you send us ideas or feedback, we may use them without owing you anything.
Availability and changes
We work to keep the App running and fast, but we cannot promise it will always be available or free of errors. We may add, change or remove features. If we remove a feature from a paid plan you are on, we will tell you first.
Disclaimers
The App is provided "as is" and "as available". To the extent the law allows, we make no warranties beyond those in these terms, including about results such as signups or sales.
Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential losses, such as lost profits, revenue or data, and our total liability to you is limited to what you paid us for the App in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.
Ending the agreement
You can stop at any time by uninstalling the App. We may end the agreement or suspend the App for you if you break these terms, or with 30 days' notice for any other reason. When it ends, your data is handled as the privacy policy describes.
General
We may update these terms. We will change the date at the top and tell you about important changes in the App or by email; continuing to use the App after that means you accept them. These terms are governed by the laws of Nepal. If part of them cannot be enforced, the rest still applies.
